{"id":6124,"date":"2026-06-09T16:04:11","date_gmt":"2026-06-09T14:04:11","guid":{"rendered":"https:\/\/michaelgkarnavas.net\/blog\/?p=6124"},"modified":"2026-06-09T16:04:12","modified_gmt":"2026-06-09T14:04:12","slug":"icc-prosecutor-suspension","status":"publish","type":"post","link":"https:\/\/michaelgkarnavas.net\/blog\/2026\/06\/09\/icc-prosecutor-suspension\/","title":{"rendered":"ICC PROSECUTOR SUSPENSION: Process, Perception, and the Cost of Prolonged Uncertainty  \u00a0"},"content":{"rendered":"<p style=\"text-align: justify;\"><blockquote class=\"otw-sc-quote\"><p>What is not good for the swarm is not good for the bee.<\/p><br \/>\n<p style=\"padding-left: 280px; text-align: justify;\"><span style=\"font-size: 10pt;\"><em>\u2013 Marcus Aurelius<\/em><\/span><\/p><\/blockquote><\/p>\n<p style=\"text-align: justify;\">What the Bureau of the Assembly of States Parties (ASP) has done in the past day is, in procedural terms, relatively clear, even if the implications are anything but routine.<\/p>\n<p style=\"text-align: justify;\">By qualified majority, the Bureau has <a href=\"https:\/\/asp.icc-cpi.int\/press-releases\/PR-20260608\" target=\"_blank\" rel=\"noopener\">decided<\/a> to initiate disciplinary proceedings against Prosecutor Karim A. A. Khan KC of the International Criminal Court (ICC): it referred the matter to the ASP for final determination and suspended him from duty with immediate effect. It has also made clear that the suspension is not determinative of the outcome and that due process continues.<\/p>\n<p style=\"text-align: justify;\">That much is straightforward.<!--more--><\/p>\n<p style=\"text-align: justify;\">But even a brief description of the procedural posture requires some clarity about what this is not. It is not a judicial finding. It is not an adjudication of guilt or liability. It is not an exoneration either. It is a disciplinary process, supported by an Office of Internal Oversight Services (OIOS) investigation, expert input, and written submissions, and now elevated to the political level of the ASP.<\/p>\n<p style=\"text-align: justify;\">This distinction matters more than it might seem at first glance because much of the surrounding commentary has tended to flatten it.<\/p>\n<p style=\"text-align: justify;\">On one side, there has been a tendency to treat the absence of judicial findings as equivalent to vindication and to treat the process itself as already a conclusion. Neither is correct. What exists instead is something more uncomfortable: an unresolved institutional process at the highest level of the ICC\u2019s governance structure, with consequences that are already real, even if the final legal character of those consequences remains to be determined.<\/p>\n<p style=\"text-align: justify;\">And it is that gap between process and perception that now defines the situation.<\/p>\n<p style=\"text-align: justify;\">Once the Prosecutor is suspended by the ICC\u2019s governing body, even provisionally, the matter is no longer merely internal discipline. It becomes an institutional condition that affects how States Parties relate to the ICC, how staff experience continuity of leadership, and how external observers interpret prosecutorial authority in ongoing and future situations.<\/p>\n<p style=\"text-align: justify;\">In that sense, time itself becomes part of the problem. Not because procedures are illegitimate, but because procedures of this nature are not cost-free. The longer they persist, the stronger their gravitational pull, drawing attention away from the ICC\u2019s mandate and toward its internal governance.<\/p>\n<p style=\"text-align: justify;\">There is also, inevitably, a parallel narrative environment that has developed around the process. Some of it is careful. Some of it is speculative. Some of it reflects deep frustration with how international institutions handle internal accountability. And some of it, as is often the case, seeks to reduce procedural complexity to simpler moral or political conclusions than the record supports.<\/p>\n<p style=\"text-align: justify;\">What one can say with confidence, however, is limited but important: there has been no judicial determination of wrongdoing; there has been no formal exoneration; and the process itself has not yet resolved the questions it was designed to address. Everything else, for now, is a matter of interpretation rather than conclusion.<\/p>\n<p style=\"text-align: justify;\">It is also worth considering what has been reported regarding the internal weight of the Bureau\u2019s assessment.<\/p>\n<p style=\"text-align: justify;\">Based on the materials considered, 19 of the 21 States involved supported proceeding with disciplinary measures. Within that group, it has been reported that a significant portion \u2013 by some accounts, around half or more of those States \u2013 considered the matter not merely serious in a formal sense but highly consequential in institutional terms. Whatever precise internal breakdown one adopts, the broader picture is difficult to dismiss.<\/p>\n<p style=\"text-align: justify;\">This is not a narrowly divided assessment, nor is it easily characterized as a matter of procedural ambiguity. It reflects a broad convergence of views that the issues raised are sufficiently grave to warrant continuation of the disciplinary process at the highest level of governance within the ICC.<\/p>\n<p style=\"text-align: justify;\">Still, interpretation has consequences of its own.<\/p>\n<p style=\"text-align: justify;\">Institutions do not operate solely on final outcomes. They operate on perceived stability, especially at the leadership level. Once that stability is formally questioned in public by the ASP\u2019s governing Bureau, it becomes difficult to restore it simply by waiting for the process to conclude.<\/p>\n<p style=\"text-align: justify;\">That is the uncomfortable reality here.<\/p>\n<p style=\"text-align: justify;\">At this point, the question is no longer only what the ASP will ultimately decide. It is also what continued pendency does to the ICC in the meantime. On that point, it is increasingly difficult to avoid the conclusion that prolonged uncertainty carries its own institutional cost \u2013 one that accumulates gradually and persistently.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-6138\" src=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?resize=521%2C347&#038;ssl=1\" alt=\"\" width=\"521\" height=\"347\" srcset=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?resize=300%2C200&amp;ssl=1 300w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?resize=1024%2C683&amp;ssl=1 1024w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?resize=768%2C512&amp;ssl=1 768w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?resize=1200%2C800&amp;ssl=1 1200w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2026\/06\/Desk1.png?w=1536&amp;ssl=1 1536w\" sizes=\"auto, (max-width: 521px) 85vw, 521px\" \/><\/p>\n<p style=\"text-align: justify;\">It affects internal cohesion. It affects external confidence. It affects the Office of the Prosecutor\u2019s (OTP) ability to operate without the shadow of unresolved governance questions at its highest level. It does so regardless of how carefully procedural neutrality is maintained.<\/p>\n<p style=\"text-align: justify;\">There is also a more subtle effect: extended uncertainty invites ongoing narrative contestation. Not necessarily because anyone intends it, but because ambiguity creates space. And in high-profile institutional disputes, that space is quickly filled.<\/p>\n<p style=\"text-align: justify;\">At some point, one has to ask whether allowing the process to continue indefinitely before the ASP actually serves the institutional interest it is meant to protect.<\/p>\n<p style=\"text-align: justify;\">And here, I find myself returning to something relatively simple.<\/p>\n<p style=\"text-align: justify;\">Whatever one\u2019s view of how this process began or how it has been managed, it has now reached a point where continuation is no longer neutral. It is consequential. Once that threshold is crossed, the question becomes whether further procedural unfolding remains the best way to protect institutional integrity or whether it has begun to undermine it.<\/p>\n<p style=\"text-align: justify;\">That is why, in my view, the most responsible course at this stage would be for Prosecutor Khan to resign rather than allow the matter to proceed to a prolonged political determination before the ASP, which will inevitably prolong uncertainty at the top of the institution.<\/p>\n<p style=\"text-align: justify;\">Any such step <em>should not<\/em> be accompanied by any negotiated financial settlement or compensatory arrangement beyond what is strictly required under the applicable framework. At this point, the concern is not reward or penalty. It is institutional continuity and avoiding arrangements that would create any perception that departure is being institutionally incentivized.<\/p>\n<p style=\"text-align: justify;\">If such a step were taken, the ASP process would effectively become unnecessary in its current form. The institution could move directly into transition, avoiding a drawn-out period of political and institutional uncertainty that is already taking a high toll.<\/p>\n<p style=\"text-align: justify;\">If it is not taken, the ASP will, of course, proceed as it must and reach its own conclusion. But it will do so in a context in which the ICC has already been operating for an extended period amid suspended leadership, narrative contestation, and institutional strain.<\/p>\n<p style=\"text-align: justify;\">Stepping back from the procedural details, what remains is a basic institutional judgment. It begs the question: at what point does continuation cease to be a neutral expression of due process and instead become an independent source of institutional vulnerability?<\/p>\n<p style=\"text-align: justify;\">It seems to me that point has already been reached. Now that it has, the question of resignation should no longer be framed in terms of individual position or entitlement but as a question of institutional responsibility, recognizing when the ICC\u2019s interests are better served by closure than by continuation.<\/p>\n<p style=\"text-align: justify;\">The ASP will do what it must. But the ICC is not strengthened by prolonging uncertainty at its apex. Institutions rarely recover stability by extending ambiguity when it matters most. At a certain point, continuity is no longer preserved by process alone, but by allowing process to conclude.
