{"id":1701,"date":"2016-10-31T00:10:22","date_gmt":"2016-10-30T23:10:22","guid":{"rendered":"http:\/\/michaelgkarnavas.net\/blog\/?p=1701"},"modified":"2016-10-31T14:41:21","modified_gmt":"2016-10-31T13:41:21","slug":"gambia-icc-exodus","status":"publish","type":"post","link":"https:\/\/michaelgkarnavas.net\/blog\/2016\/10\/31\/gambia-icc-exodus\/","title":{"rendered":"Gambia follows South Africa\u2019s ICC exodus: quelle surprise"},"content":{"rendered":"<p style=\"text-align: justify;\"><div id=\"google_language_translator\" class=\"default-language-en\"><\/div><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">The Islamic Republic of The Gambia announced late Tuesday 25 October 2016 that it was withdrawing from the International Criminal Court (ICC), or as Gambian Information Minister Sheriff Bojang <a href=\"http:\/\/www.bbc.com\/news\/world-africa-37771592\" target=\"_blank\">characterized<\/a> it, \u201cthe International Caucasian Court for the persecution and humiliation of people of colour, especially Africans.\u201d((<em> See also <\/em>the statement of the Information Minister Sheriff Bojang on Gambian television posted on YouTube by the news agency The Fatu Network, 25 October 2016, available online <a href=\"https:\/\/www.youtube.com\/watch?v=aDYRYAmPtG8\" target=\"_blank\">here<\/a>.))<\/p>\n<p style=\"text-align: justify;\">The reason for Gambia\u2019s departure is apparent.\u00a0 About a two-thirds of the African states that have signed the Rome Statute that established the ICC view the ICC as a Western court targeting Africans while giving a pass on westerners who are believed by some African heads of state to have been involved in war crimes and crimes against humanity. Former British Prime Minister Tony Blair, <a href=\"http:\/\/www.humanosphere.org\/world-politics\/2016\/10\/gambia-becomes-third-african-country-to-leave-icc-more-withdrawals-likely\/\" target=\"_blank\">as far as Gambia is concerned<\/a>, is a prime example of a Western leader (or former leader) who should be in the ICC dock for his role in the Iraq war.\u00a0 Fat chance.<!--more--><\/p>\n<p style=\"text-align: justify;\"><div class=\"perfect-pullquote vcard pullquote-align-left pullquote-border-placement-right\"><blockquote><p>In my previous post I predicted that with South Africa leaving the ICC, other African states would follow. <\/p><\/blockquote><\/div>In my <a href=\"https:\/\/michaelgkarnavas.net\/blog\/2016\/10\/26\/south-africa-files-for-divorce-from-icc\/\" target=\"_blank\">previous post<\/a> I predicted that with South Africa leaving the ICC, other African states would follow. Gambia\u2019s lighting departure is unsurprising.\u00a0 The issue of the ICC targeting only Africans has been festering for some time.\u00a0 And it will not simmer down any time soon \u2013 even if the ICC Prosecutor Fatou Bensouda were to succeed in getting some quick indictments from other continents; no small feat considering how time-consuming and complex it is to go from investigating a case to confirmation of charges.<a href=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/rats-jumping-ship.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1707\" src=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/rats-jumping-ship.jpg?resize=276%2C182&#038;ssl=1\" alt=\"rats-jumping-ship\" width=\"276\" height=\"182\" srcset=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/rats-jumping-ship.jpg?resize=300%2C198&amp;ssl=1 300w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/rats-jumping-ship.jpg?w=671&amp;ssl=1 671w\" sizes=\"auto, (max-width: 276px) 85vw, 276px\" \/><\/a>((<em> See <\/em>my previous post discussing the new Policy Paper on Case Selection and Prioritisation, <a href=\"https:\/\/michaelgkarnavas.net\/blog\/2016\/10\/13\/icc-otp-sets-out-its-vision-a-look-at-the-horizon\/\" target=\"_blank\"><em>ICC-OTP sets out its vision: a look at the horizon<\/em><\/a>, 13 October 2016. <em>See also <\/em>a recent post by Christine Schwobel on Opinio Juris, <a href=\"http:\/\/opiniojuris.org\/2016\/10\/28\/the-re-branding-of-the-international-criminal-court-and-why-african-states-are-not-falling-for-it\/?utm_source=feedburner&amp;utm_medium=email&amp;utm_campaign=Feed%3A+opiniojurisfeed+%28Opinio+Juris%29\" target=\"_blank\"><em>The Re-branding of the International Criminal Court (and Why African States Are Not Falling For It)<\/em><\/a>, 28 October 2016.))<\/p>\n<p style=\"text-align: justify;\">Many African leaders see a pernicious and persistent double standard, an aversion by the ICC to investigate and prosecute Western (Caucasian) and non-African leaders. But I dare say that this is more of a pretext and not the root cause.\u00a0 As I have noted before, my take is that there is a sobering realization that heads of state are fair game for the ICC.\u00a0 What is a strongman such as Gambia President Yahya Jammeh (who has been characterized as <a href=\"http:\/\/www.bbc.com\/news\/world-africa-24383225\" target=\"_blank\">eccentric and ruthless<\/a>) to do?\u00a0 Somewhat na\u00efve of such heads of state to have signed on to the Rome Statute in the first place.\u00a0 Now that the chickens are coming home to roost, and having little leverage to game the process if charged, the time seems ripe to extricate themselves from the ICC\u2019s grip.<\/p>\n<p style=\"text-align: justify;\">Gambia\u2019s exodus must be particularly distressing for Ms. Bensouda.\u00a0 She is from Gambia.\u00a0 She is reported to have been Chief Legal Adviser to President Yahya Jammeh after he seized power by orchestrating a coup in 1994.\u00a0 She served as President Jammeh\u2019s Minister of Justice from 1998 to 2000.(( <em>See <\/em>Ms Fatou Bensouda\u2019s Biography on the ICC web <a href=\"https:\/\/www.icc-cpi.int\/about\/otp\/who-s-who\/pages\/fatou-bensouda.aspx\" target=\"_blank\">here<\/a>.)) She holds her position as ICC Prosecutor in part because of President Jammeh; he would have had to support her candidacy when she ran to be elected ICC Prosecutor, and no doubt he lobbied for her with other states, most notably African states. In fact, so the open secret goes, Ms. Bensouda was elected, in part, because she hailed from Africa and, it was perceived, would thus be more sympathetic and sensitive to the complaints of African leaders that the ICC was solely targeting Africans. With Ms. Bensouda at the helm, so the thinking went, she would either stem the tide of African prosecutions or at least initiate proceedings against non-Africans.<\/p>\n<figure id=\"attachment_1706\" aria-describedby=\"caption-attachment-1706\" style=\"width: 263px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/ocampo-and-bensouda.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-1706\" src=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/ocampo-and-bensouda.jpg?resize=263%2C175&#038;ssl=1\" alt=\"ocampo-and-bensouda\" width=\"263\" height=\"175\" srcset=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/ocampo-and-bensouda.jpg?resize=300%2C200&amp;ssl=1 300w, https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/ocampo-and-bensouda.jpg?w=600&amp;ssl=1 600w\" sizes=\"auto, (max-width: 263px) 85vw, 263px\" \/><\/a><figcaption id=\"caption-attachment-1706\" class=\"wp-caption-text\">Luis Moreno-Ocampo, Fatou Bensouda<\/figcaption><\/figure>\n<p style=\"text-align: justify;\">This was wishful thinking \u2013 at least in the short term. Ms. Bensouda, though number two under the now infamous first prosecutor <a href=\"https:\/\/michaelgkarnavas.net\/blog\/2016\/10\/13\/icc-otp-sets-out-its-vision-a-look-at-the-horizon\/\" target=\"_blank\">Luis Moreno-Ocampo<\/a>, inherited the Titanic headed for an iceberg.\u00a0 Try as she has, it takes time to change course.\u00a0 Cases that were in line for prosecution had to proceed.\u00a0 And as we now know, several had to be dismissed or were dismissed.<\/p>\n<p style=\"text-align: justify;\">The bigger story, however, is not so much that Gambia has joined South Africa (and Burundi) in jumping the ICC ship, but how relatively easy it is for State Parties to the ICC to uncouple themselves from their obligations under the Rome Statute.\u00a0 If the ICC has an Achilles heel, this is it.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/JohnAckerman.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1708\" src=\"https:\/\/i0.wp.com\/michaelgkarnavas.net\/blog\/wp-content\/uploads\/2016\/10\/JohnAckerman.jpg?resize=120%2C149&#038;ssl=1\" alt=\"johnackerman\" width=\"120\" height=\"149\" \/><\/a>In <a href=\"https:\/\/michaelgkarnavas.net\/blog\/2016\/10\/26\/south-africa-files-for-divorce-from-icc\/#comment-3982\" target=\"_blank\">a comment to my post on South Africa<\/a>, John Ackerman \u2013 a defense lawyer extraordinaire and old ICTY hand \u2013 eloquently noted many of the problems with the ICC and why it may, in the long run, suffer the same fate as the League of Nations.\u00a0 In Ackerman\u2019s words:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">The ICC was doomed from the very beginning. It was just a matter of time until it would begin to disintegrate. It is now happening. The court costs millions of dollars to keep it afloat. It needs to be closed down. We can rely on Ad Hoc criminal tribunals to deal with international war crimes when it becomes necessary as we have very successfully done since creation of the ICTY. Every day that the ICC continues is simply a waste of time and money and a denigration of International Criminal Courts. Ad Hoc courts work very well.
